AUSTIN, Texas (AP) — Texas Gov. Rick Perry’s first court appearance to face abuse of power charges has been pushed back a week to Nov. 7.

A judge in Austin last week had ordered the Republican to appear for a pretrial hearing Oct. 31. Perry’s attorney Tony Buzbee said Tuesday the hearing has been delayed.

A grand jury indicted Perry in August on charges he abused his official capacity and coerced a public servant, stemming from his public threat and eventual decision to veto state funding for public corruption prosecutors. That came after the Democratic district attorney overseeing the investigative unit refused to resign following her conviction for drunken driving.

Perry maintains he was within his rights. His high-powered defense team has challenged the case on constitutional and technical grounds.
