WASHINGTON – Federal prosecutors say they want DNA testing on the man convicted of beating an 83-year-old woman who sold T-shirts near the Foggy Bottom Metro station in 2005.
James Dorsey’s conviction was overturned a few weeks ago after an appeals court threw out his confession, but he remains in a West Virginia prison.
Thursday, a judge refused to let him walk out of prison, but ordered Dorsey to be brought back to D.C. for a hearing on whether he should be released.
Prosecutors say they will decide whether to retry him based on the results of the DNA tests.
