CHARLOTTESVILLE, Va. (AP) — A judge has dismissed a portion of a lawsuit filed by the mother of a slain Virginia Tech student against a security company.

The portion thrown out by Charlottesville Circuit Court Jay Swett had accused Regional Marketing Concepts Inc. of breaching its contract by not protecting Morgan Harrington from criminal behavior.

Swett allowed the lawsuit filed by Harrington’s mother, Gil Harrington, to move forward. He ruled that Regional Marketing might have been negligent when its staff denied Morgan Harrington re-entry to the John Paul Jones arena on Oct. 17, 2009.

Media outlets report that Swett issued his ruling Tuesday.

Morgan Harrington disappeared after she left the arena in Charlottesville, where she had attended a Metallica concert. Her remains were found in January 2010 in a hayfield.
