WASHINGTON — The driver of a food truck who crashed into an Ashburn woman’s car in Leesburg, Virginia, killing the mother of three, has been indicted by a grand jury on involuntary manslaughter charges.

In the true bill returned against Tony Steven Dane Monday, Loudoun County Circuit Court grand jury also indicted him on charges of reckless driving, driving without a license, not having insurance and failing to have the food truck inspected.

Authorities said Dane was driving the converted school-bus-turned-food-truck Sept. 8 when he ran a stop sign and crashed into 39-year-old Erin Kaplan’s Audi on Evergreen Mills Road.

Kaplan was killed in the crash. Her teen son was critically injured and her two daughters and her mother suffered serious injuries, according to a GoFundMe page set up on behalf of the Kaplan family.

After the crash, Virginia authorities put in place several short-term safety improvements at the intersection of Evergreen Mills Road and Watson Road, where the crash took place.

Dane is due in court Tuesday where he will be served with the indictment.
