BRENTWOOD, N.H. (AP) — Lawyers for an unlicensed New Hampshire driver charged with driving into a group of bicyclists, killing two of them, are seeking to suppress blood samples from evidence in her upcoming trial.

Police said 20-year-old Darriean Hess of Seabrook was driving last September without a license, speeding and under the influence of drugs when she ran into the bicyclists in Portsmouth. Two were killed.

Foster’s Daily Democrat reports (http://bit.ly/1oLLR2j) Hess’ lawyers said she didn’t want medical treatment, but was taken to a hospital, where four tubes of blood were drawn. Tests showed Hess had ingested several drugs.

The attorneys said withdrawing blood without a warrant or consent is an illegal search and seizure and Hess didn’t sufficiently understand the consequences of her actions.

A hearing has been scheduled for Oct. 6.
