Dave & Buster’s has 30 days to leave White Flint

Dave & Buster’s has lost its court fight to keep its restaurant at White Flint Mall open.

U.S. District Judge Roger Titus ruled this week in favor of its White Flint landlord, agreeing that Dave & Buster’s violated a distance-based requirement in its lease when it opened another restaurant at nearby Arundel Mills Mall in 2006. Titus also threw out Dave & Buster’s challenge to its eviction.

The court order gives Dave & Buster’s 30 days to vacate its White Flint space.

Dave & Buster’s was one of two anchor tenants at White Flint that sued in federal court to block or delay the mall’s planned redevelopment.

Titus had earlier ruled that the mall’s owners, The Tower Cos and Lerner Enterprises, gave Dave & Buster’s fair notice in September 2012 that it had violated its lease agreement.
