STROUDSBURG, Pa. (AP) — A northeastern Pennsylvania prosecutor is objecting to a federal magistrate’s recommendation that a South Korean man convicted of killing his daughter in what authorities called was an arson 25 years ago should be released from prison or given a new trial.

A federal judge will consider U.S. Magistrate Judge Martin C. Carlson’s June 13 recommendation to set aside the conviction of 79-year-old Han Tak Lee. Carlson says the science underpinning the case has been discredited.

The Monroe County district attorney’s office filed an objection Friday, saying that Carlson underplayed the other evidence in the case.

Lee is serving a life sentence. He has long argued the July 1989 fire that killed 20-year-old Ji Yun Lee at a religious retreat in the Pocono Mountains was accidental.
