Anchor retailer Lord & Taylor LLC is taking a new tack in its lawsuit against the owners of the White Flint Mall after losing a pair of key rulings in its effort to block the mall’s redevelopment into a town center.

Lord & Taylor filed an amended complaint in the U.S. District Court in Greenbelt on May 23 once again seeking an injunction to block the redevelopment but this time saying it wants monetary damages if the court rules against it. The department store wants to block the mall’s redevelopment until its lease expires in 2055.

Federal court Judge Roger Titus rejected Lord & Taylor’s request for an injunction in December that sought to block the mall’s owners, principals of Lerner Enterprises and The Tower Cos., from converting the 800,000-square-foot mall into a 5.2 million-square-foot mixed-use development. Lord & Taylor appealed, but a panel of judges upheld the ruling in mid-March. Its amended complaint is a shift in approach and opens the door to a potential settlement between the retailer and mall owner after nearly a year in court.

The lawsuit is one of three filed to block the mall’s redevelopment. Dave & Buster’s and Lawrence Lerner, the brother of Washington Nationals owner Ted Lerner, have also sued seeking to delay the project.
