BOSTON (AP) — An FBI agent says two friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR’ tsahr-NEYE’-ehv) signed consent forms before being interviewed by investigators.
Special Agent Farbod Azad said in federal court on Wednesday that the two were read their rights and told that they were not under arrest. Another agent testified that he told them they could leave if wanted.
According to documents shown in court, Dias Kadyrbayev (DY’-us kah-dur-BY’-ehv) signed consent for the FBI to search his car, apartment and laptop.
Kadyrbayev is charged with tampering with evidence for removing Tsarnaev’s laptop and a backpack containing fireworks from his University of Massachusetts Dartmouth dorm room.
His attorney argues that his client was interviewed involuntarily and his apartment illegally searched. He is fighting to keep Kadyrbayev’s statement out of his September trial.
Kadyrbayev will likely testify Thursday.
